This is an Indemnity Agreement (“the Agreement”) which is made under Common Law and which is made and effective digitally through the Company Website on this day/date of digital execution/agreement.
Indemnity Agreement
BETWEEN :-
MONASCREEBAN EQUESTRIAN CENTRE LIMITED, (the “Indemnitee”), (“the Company”) (Trading As “The Field Equestrian Centre”) , a Limited Liability Company, organised and existing under the laws of the IRELAND, (A Private Members Club) with its head office located at:- Monascreeban, Ballyadams, Co. Laois. R14 X652. Ireland.
AND:-
The Person(s) named in the Registration process/form (“the Indemnitor(s)”), an individual(s) with his/her/their main address(es) located at:- As recorded in the digital Registration process/form.
In consideration of the sum of €1.00 and other good and valuable consideration, receipt of which is acknowledged, on behalf of themselves, their heirs, assigns and successors, jointly and severally enter into this Indemnity Agreement to hold each other harmless form any suit, liability, claim, action or loss whatsoever arising out of the below described incident/activities, the parties agree as follows:-
1. LIABILITY, LOSS OR DAMAGE
Indemnitor(s) undertakes to indemnify Indemnitee from any and all liability, loss, injury and or damage Indemnitor(s) and or Indemnitor(s) Horse(s) may suffer as a result of indemnitor(s) use of Indemnitees facility(ies)/premises and or property where Indemnitor(s) intend(s) to knowingly and wilfully engage in the knowingly and readily accepted dangerous activities of Horse Riding, Horse Jumping, Horse Walking, Horse Transport, Horse Feeding, Horse Grooming, Horse Washing, Horse Training, Horse Maintenance, of any/all nature(s) whatsoever inter alia, and or any authorised and or unauthorised use/misuse of any of the Indemnitees machinery and or equipment and or facilities in any context whatsoever.
Indemnitor(s) further undertake(s) to indemnify Indemnitee from any/all claims, demands, costs, or judgments against Indemnitor(s) and or Indemnitee arising from indemnitor(s) use of Indemnitees facility(ies)/premises and or property where Indemnitor(s) interaction(s) with other Members of Indemnitees Equestrian Centre/Private Members Club and or their Horses as a consequence of Indemnitor(s) knowingly and wilfully engaging in the readily accepted dangerous activities of Horse Riding, Horse Jumping, Horse Walking, Horse Transport, Horse Feeding, Horse Grooming, Horse Washing, Horse Training, Horse Maintenance, of any/all nature(s) whatsoever inter alia, and or any authorised and or unauthorised use and or misuse of any of the Indemnitees machinery and or equipment and or facilities in any context whatsoever.
Indemnitor(s) further undertake(s) to indemnify Indemnitee from any/all claims arising from, any/all interaction(s) between Indemnitor(s) and any/all other users/members of the Indemnitees facility(ies) / premises and or property and or any and all liability, loss, injury and or damage caused by the Indemnitor(s) to any/all of these other users/members and or their Horse(s) and or property inter alia.
Indemnitor(s) further undertake(s) to indemnify Indemnitee from any/all claims arising from the Indemnitor(s) causing/facilitating any Individual(s)/Person(s) whom are NOT Members of the Company/Equestrian Centre/Club in attending at and or entering upon the Indemnitees private property/facility (Private Members Club).
2. DURATION
Indemnity under this agreement shall commence on the day/date of Registration/execution as a member of the Field Equestrian Centre Private Members Club on the Company website and shall continue in full force until six years after the last known/actual use by the Indemnitor(s) of the Indemnitees facility(ies)/premises/property.
3. REQUIREMENT OF NOTICE TO INDEMNITEE / INDEMNITOR
Indemnitor(s) agree(s) to notify Indemnitee in writing, within twenty one (21) days, by registered post, at Indemnitees address as stated in this agreement, of any claim made against Indemnitor(s) on the obligations indemnified against.
Indemnitee agrees to notify Indemnitor(s) in writing, within twenty one (21) days, by registered post, at Indemnitor(s) address(es) as stated in this agreement, of any claim made against Indemnitee pertaining to Indemnitor(s) interactions inter alia with other users/members on the obligations indemnified against.
4. WITNESS:-
On the day/date of registration/execution of Registration as digitally recorded on the Website of the Company (“the Indemnitor(s)”), personally executed the herein Agreement, “the Indemnitee” who is identified by its website, and “the Indemnitor(s)” who proved his/her/their identity/identities by recording his/her Driving License Number being satisfactory evidence to be the person(s) whose name(s) is/are subscribed to the within instrument, and acknowledge that he/she/they executed the same in his/her/their authorised capacity, and that by his/her/their execution of the Registration as a Member process/form of The Field Equestrian Centre Private Members Club on the fieldequestriancentre.ie website, the person(s), or the entity/entities and or Minor(s) upon behalf of which the Indemnitor(s) acted, executed the herein instrument.
IN WITNESS WHEREOF, each party to this agreement has caused it to be executed at:- thefieldequestriancentre.ie which is registered at Monascreeban, Ballyadams, Co. Laois. R14 X652. Ireland. And Owned by MONASCREEBAN EQUESTRIAN CENTRE LIMITED on the date indicated hereinabove.
